Michael Jordan Tells Court He Felt No Fear of Nascar in Antitrust Trial
Michael Jeffrey Jordan, as he cordially introduced himself in a federal courtroom on Friday, stated that his competitive side and novelty within the sport motivated his effort with 23XI Racing to “challenge” Nascar over alleged violations of antitrust rules.
Team Investment and a Will to Win
Jordan shared operational insights of his racing venture, revealing he invested $40m of his personal wealth into the Nascar Cup series team co-founded with business partner Curtis Polk and driver Hamlin.
“It fell to someone to act,” Jordan stated during testimony. “As a newcomer, I wasn’t afraid. I felt I could challenge Nascar as a whole. From my perspective, the sport it needed to be looked at from a different view.”
The Core Dispute: Charter Agreements and Contract Pressure
At issue is the expiration of a 2016 agreement where Nascar granted each team a “charter”. This system mirrors other major leagues with independent franchises, like the NBA’s Hornets or the NFL’s Panthers. This deal was set to expire in 2024 when Nascar demanded charter membership renewals.
Jordan testified for an hour and left the court to a media frenzy, with fans and media vying for a view or a photo of the global icon.
Spearheading the Fight
Jordan’s 23XI is leading the full-court press along with Front Row Motorsports for Nascar to overhaul a business model Jordan said is unlawful to maintain excessive control.
At issue for Jordan and Heather Gibbs, who preceded Jordan, are details from last September. She recounted a hectic and tense period where the sanctioning body told teams they must sign a contract extension. This agreement spanned 112 pages detailing team compensation and a guaranteed entry in every race.
Choosing Litigation
Jordan explained that 23XI and Front Row Motorsports concluded their sole viable path was to decline to sign that 112-page package and litigate the matter. All other teams signed the agreement.
The team owners approached Nascar about potential amendments or extension options. Nascar wasn’t talking, according to his testimony.
The Bottom Line: Winning
But in the end, the pushback against what he saw as a unsustainable system was driven by the familiar goal for Jordan: Winning.
“Hamlin persuaded me getting a third driver boosted our odds of winning,” he said, noting that he purchased another franchise last year for $28m amid the legal dispute. “So I took the plunge.”
Account from the Gibbs Family
Gibbs described her request for permanent charters, submitted in a formal letter to Nascar. She said the timing of the contract signing demand didn’t sit well.
She said, the team founder first attempted to call and talk Nascar out of demanding signatures, but CEO Jim France refused the appeal.
“Don’t do this to us,” Heather Gibbs said Joe Gibbs told Nascar’s executives. She said France replied, “If I wake up and I have 20 charters, I have 20. If there are 30, I have 30.”
