Spain's Chief Prosecutor Convicted in Contentious Leak Case

The nation's Attorney General, the country's chief legal officer, has been forced to resign after being convicted of revealing classified details in a highly contentious case that has accentuated political divisions within the country.
Judicial Decision and Sanctions
The highest court found that the attorney general had illegally disclosed information about the tax situation of businessman Alberto González Amador, who is the boyfriend of a senior conservative politician.
The judicial body handed down a 24-month prohibition from his position and a penalty of seven thousand two hundred euros. Furthermore, he must pay €10,000 to the businessman as restitution.
Political Consequences
The legal proceedings of the attorney general fueled the already acrimonious relations between the left-wing government of the nation's leader and the conservative political forces.
Contrasting positions were highlighted by reactions to the conviction.
"Sánchez must apologise to the Spanish people, resign and schedule new elections, in that order," said Ester Muñoz for the main opposition party.
The administration stated it did not agree with the decision but respected it and would move forward with the appointment of a replacement prosecutor.
Legal Controversy
However, numerous politicians on the left expressed anger at what they viewed as a politically motivated ruling.
Health Minister Mónica García, of the progressive coalition, stated the conviction dealt a "lethal blow to presumption of innocence" and compromised citizens' rights when it came to the rule of law.
Case Background
The complex case dates back to March 2024, when the attorney general's office issued a press release indicating that Mr González Amador had sought a negotiated settlement after being found to have evaded tax payments worth €350,951.
The statement corrected mistaken press reports stating that the prosecutor's department had proposed the bargain.
The source of the incorrect reports was the head of communications of the regional leader of Madrid.
Legal Proceedings
Mr González Amador filed a complaint against the attorney general, claiming his confidentiality was violated. The case against García Ortiz also saw him accused of disclosing details about the affair to the media.
Legal authorities highlighted the prosecutor's decision to replace his mobile device as incriminating.
However, there was no direct evidence connecting García Ortiz to the disclosure and multiple reporters stated under oath during the proceedings that he had not been the source of their reporting.
Regarding the press statement, the prosecutor stated he was simply correcting the erroneous reports.
García Ortiz can appeal against the ruling.
